⽤可能な状態」で提供され、明⽰的または黙⽰的を問わず、商品性、商品的品質、特定⽬的への適合性、耐久性、権原、および権利を侵害していないことに関
するすべての黙⽰的な保証または条件を含む、いかなる種類の表明、保証または条件もないものとします。
いかなる場合においても、Nostalgic Cards、当社の取締役、役員、従業員、関連会社、代理店、請負業者、インターン、サプライヤー、サービスプロバイダー
またはライセンサーは、契約、不法⾏為（過失を含む）に基づいているかどうかにかかわらず、逸失利益、逸失収益、逸失貯蓄、データの損失、交換費⽤、ま
たは同様の損害を含むがこれらに限定されない、いかなる種類の傷害、損失、請求、直接的または間接的、偶発的、懲罰的、または結果的な損害に対して責任
を負うものではありません。また、当社のサービスを利⽤して購⼊した商品の使⽤にあたっての厳格責任及びその他責任、当社のサービスまたは商品を利⽤す
る場合の損害賠償（コンテンツ内のエラーまたは内容脱落を含むがこれに限らず）、または当社のサービスまたは当社のサービスを介して投稿、送信、または
その他の⽅法で利⽤可能になったコンテンツ（または商品）の使⽤の結果として発⽣した損失または損害について、その可能性を知らされていたとしても、責
任を負わないものとします。

パートナー、役員、取締役、代理店、請負業者、ライセンサー、サービスプロバイター、下請け業者、サプライヤー、インターンおよび従業員を補償し、防御
し、免責することに同意します。

解約⽇前に発⽣した当事者の義務および債務は、あらゆる⽬的において本契約の終了後も存続するものとします。第17条 - 補償
お客様は、以下の事由に起因または関連して第三者に支払うべき損失、損害、責任または請求（合理的な弁護士費用を含む）について、ノスタルジック・カード、Shopify、および当社の関連会社、パートナー、役員、取締役、従業員、代理人、請負業者、ライセンサー、サービスプロバイダーを補償し、防御し、免責することに同意します。(1) お客様による本利用規約または参照により組み込まれる文書の違反、 (2) お客様による法令または第三者の権利の侵害、または (3) お客様による本サービスのアクセスおよび利用に起因または関連して生じるもの。
当社は、補償対象となる請求について通知します。ただし、遅延した通知があった場合でも、お客様に重大な不利益が生じない限り、お客様の義務が免除されることはありません。当社は、弁護士の選択を含め、お客様の費用負担で当該請求の防御および和解を管理することができますが、お客様の同意（不当に保留されないもの）なしに、お客様に金銭以外の義務を課す請求については和解しません。お客様は、関連書類の提供を含第18条 - 規定の分離可能性
本利用規約のいずれかの規定が、違法、無効、または執行不能と判断された場合、当該規定は適用される法律で許容される最大限の範囲で執行可能であり、執行不能な部分は本利用規約から分離されたものとみなされる。かかる判断は、残りの規定の有効性および執行可能性に影響を及ぼさない。

第19条 - 権利放棄；完全合意

本利用規約および当社がサービスを提供する個別の契約は、Nostalgic Cardsの本社所在地を管轄する連邦裁判所および州裁判所または準州裁判所の管轄に服し、同裁判所の準拠法に従って解釈されるものとします。お客様とNostalgic Cardsは、当該裁判所における裁判地および人的管轄権に同意するものとします。
